These Terms of Use (“Terms”) are an agreement between you and Apply Magic regarding applymagic.ai and any related services (the “Service”). By using the site, joining the waitlist, or creating an account, you agree to them. If you do not, do not use the Service.
Privacy is handled separately in our Privacy Policy.
1. The Service
Apply Magic helps people prepare and send job-application materials. During private beta the Service may be incomplete, invite-only, or change without notice.
Joining the waitlist does not guarantee access, a launch date, or a price. We may accept, delay, or decline any request.
2. Eligibility
- You must be at least 18, or the age of majority where you live.
- You must be able to form a contract.
- You may not use the Service if you are barred under U.S. sanctions or similar laws.
If you use Apply Magic for an organization, you represent that you can bind it to these Terms.
3. Accounts
You are responsible for the accuracy of what you give us and for keeping your login to yourself. Tell us at hello@applymagic.ai if you think someone else is in your account. We may suspend accounts that look compromised or abusive.
4. Your content
“Your Content” means resumes, writing samples, job listings, edits, and anything else you upload or type into the Service.
- You keep ownership of Your Content.
- You grant Apply Magic a worldwide, non-exclusive license to host, process, display, and create derivative drafts from Your Content solely to provide and improve the Service for you.
- You represent that you have the right to upload it, and that it does not infringe someone else’s rights or break the law.
You can delete Your Content from your account. Residual copies may remain in backups for a limited time.
5. Outputs
Drafts the Service generates (“Outputs”) are produced by software, including third-party models. Outputs can be incomplete, generic, outdated, or wrong. They are not legal, career, or immigration advice.
- Review every Output before you send it to an employer or anyone else.
- You are solely responsible for applications you submit, including truthfulness, tone, and any claim about your experience.
- Do not represent an Output as purely human-written if a recipient or platform requires disclosure.
- Subject to the rights of model providers and these Terms, as between you and Apply Magic, you may use Outputs for your own job search.
We do not guarantee interviews, offers, or any particular result.
6. Acceptable use
You may not:
- Lie about who you are or invent work history and ask us to present it as fact.
- Use the Service to spam employers, scrape sites you are not allowed to scrape, or circumvent application limits in a way that violates a third party’s terms.
- Upload malware, attempt to break into the Service, or probe it except through a coordinated disclosure we have agreed to.
- Resell access, scrape the product to train a competing model, or reverse engineer except where the law says you may.
- Use the Service for anything unlawful, including discrimination that the law forbids.
We can refuse, limit, or terminate access if you violate these rules.
7. Fees
The waitlist and this website are free. If we introduce paid plans, prices and billing terms will be shown before you buy. Fees are generally non-refundable except where the law requires otherwise or we say so at checkout. We may change prices with notice for the next billing cycle.
8. Intellectual property
The Service — including the name Apply Magic, the spark mark, the site design, and our software — is owned by us or our licensors. These Terms do not give you any right to our brand except the limited permission to use the Service as offered.
If you send feedback, we may use it without obligation to you.
9. Third-party services
The Service may call model providers, hosting companies, job boards, or payment processors. Their terms apply to their piece. We are not responsible for sites we do not control.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL GET YOU HIRED.
11. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, APPLY MAGIC AND ITS PEOPLE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST OPPORTUNITIES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS.
Some places do not allow these limits. In those places, our liability is limited to the maximum permitted.
12. Indemnity
You will defend and indemnify Apply Magic against claims that arise from Your Content, your applications, or your misuse of the Service, except to the extent we caused the harm.
13. Termination
You may stop using the Service at any time. We may suspend or end access if you break these Terms, if we shut the product down, or if we have to for legal reasons. Sections that should survive — including 4–12 and 14–15 — will survive.
14. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Except where the law requires otherwise, you and Apply Magic agree to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
If you are a consumer in a place that will not honor that choice, the mandatory rules of your home jurisdiction still apply.
15. Changes
We may update these Terms. The new version applies after we post it, or on a later date we name. If a change is material and you have an account, we will try to email you. Continued use after that date is acceptance.
16. Miscellaneous
These Terms are the whole agreement about the Service. If a court knocks out one part, the rest stays. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale. A failure to enforce a term is not a waiver.
